Notice is hereby given that a hearing will be held at 2:00 p.m. Central Time, on Tuesday, December 8, 2015, in the offices of the Alabama Department of Insurance, 201 Monroe Street, Fifth Floor Conference Room, RSA Tower, Montgomery, Alabama, as follows: 

 

Adoption of new Insurance Regulation No. 160 [Chapter 482-1-160], setting forth the rules necessary to carry out the provisions of Ala. Act No. 2015-441, permitting the increase of certain fees by the percentage increase in the Consumer Price Index over a period of up to ten years, as authorized in Ala. Act No. 2015-441. The fees proposed to be increased are for service contract provider registration, initial and annual renewal, as initially set in 1997 in Section 8-32-3, Code of Alabama 1975, and the premium finance company annual licensefee, as initially set in 1975 in Section 27-40-3, Code of Alabama 1975. The proposed effective date of the newregulation is April 1, 2016.  (6 pages)

 

Amendments to Section 6 of Insurance Regulation No. 110 [Rule 482-1-110-.06], which sets forth the fees paid by education providers in connection with continuing education for insurance producers andservice representatives.  The fees wereinitially set in 1996 in Section 27-8A-9, Code of Alabama 1975.  The amendmentsadjust the fees according to changes in the Consumer Price Index over the lastten years as permitted by Alabama Act No. 2015-441.  The proposed effective date of the amended rule is January 1, 2016.  (4 pages)


Revision of State Fire Marshal Regulation No. 103 [Chapter 482-2-103], which sets forth the fees necessary for theadministration and enforcement of the Fire Protections Sprinkler Systems Act.  The fee was originally set in 1988 in Section 34-33-4, Code of Alabama 1975. The revisions adjust the fees according to changes in the Consumer Price Index over the last ten years as permitted by Alabama Act No. 2015-441.  The proposed effective date of the revisions is January 1, 2016.  (5 pages)

 

Repeal of State Fire Marshal Regulation No. 104 [Chapter 482-2-104], which formalizes the practice of granting and sets the fee for requesting approval of emergency variations from the Alabama Explosives Safety Act of 1993.  The fee will be hereafter set forth in proposed new State Fire Marshal Regulation No. 106 [Chapter 482-2-106].  (3 pages)


Adoption of new State Fire Marshal Regulation No. 105 [Chapter 482-2-105], setting forth the fees necessary for the administration and enforcement of Article 8 of Chapter 17 of Title 8, Code of Alabama 1975, relating to the regulation of the manufacturing, sale and display of fireworks in this state.  The fees were initially set in 2003 in Section 8-17-211, Code of Alabama 1975.  The revisions adjust the fees according to changes in the Consumer Price Index over the last ten years as permitted by Alabama Act No. 2015-441. The proposed effective date of the new regulation is January 1, 2016.  (4 pages)

 

Adoption of new State Fire Marshal Regulation No. 106 [Chapter 482-2-106], setting forth the fees necessary for the administration and enforcement of Article 9 of Chapter 17 of Title 8, Code of Alabama 1975, known as the Alabama Explosives Safety Act of 1993.  The fees were initially set in 2003 in Sections 8-17-243 and 8-17-247 and in 1993 in Section 8-17-250, Code of Alabama1975.  The revisions adjust the fees according to changes in the Consumer Price Index over the last ten years as permitted by Alabama Act No. 2015-441.  The proposed effective date of the new regulation is January 1, 2016.  (2 pages)

 

Adoption of new State Fire Marshal Regulation No. 107 [Chapter 482-2-107], setting forth the fees necessary for the administration and enforcement of Article 10 of Chapter 17 of Title 8, Code of Alabama 1975, known as the Reduced Cigarette Ignition Propensity Standards and Firefighter Protection Act.  The fees were initially set in 2009 in Section 8-17-273, Code of Alabama 1975.  The revisions adjust the fees according to changes in the Consumer Price Index over the last six years as permitted by Alabama Act No. 2015-441.  The proposed effective date of the new regulation is January 1, 2016.  (2 pages)

 

Adoption of new State Fire Marshal Regulation No. 108 [Chapter 482-2-108], setting forth the fee necessary for the administration and enforcement of Chapter 33A of Title 34, Code of Alabama1975, relating to the regulation of the business of installation, repair,alteration, addition, maintenance, or inspection of a fire alarm system in this state.  The fee was initially set inSection 34-33A-5, Code of Alabama 1975.  The revisions adjust the fees according to changes in the Consumer Price Index over the last ten years as permitted by Alabama Act No.2015-441.  The proposed effective date of the new regulation is January 1, 2016.  (2 pages)

 

Revision of Preneed Regulation No. 2 [Chapter 482-2-002], which sets various fees as authorized in 2002 in Section 27-17A-11, Code of Alabama 1975, known as the Alabama Preneed Funeral and Cemetery Act.  The revisions adjust the fees according to changes in the Consumer Price Index over the last ten years as permitted by Alabama Act No. 2015-441. The proposed effective date of the revision is January 1, 2016.  (4 pages)
