Notice of Regulation Hearing

Notice is hereby given that a hearing will be held at 10:00 A.M. on Wednesday, December 14, 2005, at the offices of the Alabama Department of Insurance, 201 Monroe Street, Suite 1700, RSA Tower, Montgomery, Alabama, as follows:

 

Revision of Regulation No. 91 [Chapter 482-1-091], which is known as the Long-Term Care regulation, as necessary to comply with the revised National Association of Insurance Commissioners (NAIC) Model Regulation.  The proposed revisions are designed to cause this regulation to be substantially similar to this NAIC Model Regulation.  (72 pages)

 

Revision of Appendix A of Regulation No. 134 [Chapter 482-1-134], which is known as the Health Insurance Reserves regulation so as to correct a typographical error by inserting the word “not” in section II paragraph B.  (7 pages)

 

Revision of Regulation 119 [Chapter 482-1-119], which is  known as the Restrictions on Loans obtained by Insurance Producers from their clients regulation so as to change “agents” to “producers” and to reformat this regulation.  (5 pages)

 

Repeal of Regulation 5 [Chapter 482-1-005], known as Fire and Casualty Form and/or Rate Filings, which become effective September 1, 1961.  The provisions of this regulation have been superseded by newer law and regulation.  (1 page) 

 

Repeal of Regulation No. 37 [Chapter 482-1-037], known as Filings of Amendments to Charters, Articles of Incorporation, Name Changes, Mergers, and Intention to Withdraw from Alabama, with the Office of the Secretary of State which became effective March 15, 1960.  The provisions of this regulation have been superseded by newer law and regulation.  (2 pages)

           

Repeal of Regulation 46 [Chapter 482-1-046], known as Insurance-Rebates-Trading Stamps which became effective August 25, 1966.  The provisions of the regulation have been superseded by newer law and regulation.  (1 page)

 

Repeal of Regulation 61 [Chapter 482-1-061], known as Salvage and Subrogation which became effective March 10, 1977.  The provisions of this regulation have been superseded by newer law and regulation.  (1 page)

 

Repeal of Regulation 92 [Chapter 482-1-092], known as Self-Referral Option by HMO Enrollees and HMO Arrangements with Providers, which became effective November 30, 1996.  This regulation has been superseded by law and regulation.  (11 pages)

 

Adoption of proposed new Regulation No. 135 [Chapter 482-1-135], to be known as the Mediation Alternative Procedures For Resolution Of Disputed Personal Lines Insurance Claims Arising From Hurricane and Tropical Storm Damage.  The purpose of the new regulation is to set forth standards to mediate residential property lines claims after a disaster.

 

Adoption of proposed new Regulation No. 136 [Chapter 482-1-136] to be known as Notice Requirements For Coverage Restrictions Of Existing Policies At Renewal.  The purpose of the new regulation is to require insurers, under certain circumstances, to provide notice of a proposed coverage restriction to be imposed at renewal so that policyholders have time to shop for alternative coverage if so desired.

 

Any person wishing to submit testimony at said hearing is requested to submit said testimony in writing to the Alabama Department of Insurance, Attention: Legal Division, Post Office Box 303351, Montgomery, Alabama 36130-3351.  Any written submission of testimony prior to the hearing will not preclude anyone from making an oral or written presentation at the hearing.
