Pharmacy Benefit Manager Actions

The Alabama Legislature enacted the Community Pharmacy Relief Act (Act 2025-136) during the 2025 legislative session. The new law established requirements for Pharmacy Benefit Managers operating in Alabama and expanded the regulatory authority of the Alabama Department of Insurance to oversee and enforce compliance.

In response, the Department created the PBM Compliance Division in 2025 to implement and enforce the new law. The Division oversees PBM licensing, investigates complaints, and works closely with PBMs, pharmacies, insurers, and other healthcare stakeholders to monitor compliance with Alabama law, address pharmacy provider complaints, and promote consistent regulatory standards within the state’s pharmacy benefit marketplace. Through these efforts, the Department seeks to ensure that PBMs operating in Alabama conduct business in accordance with state law while supporting fair reimbursement practices, transparency, and continued access to pharmacy care for Alabama residents.

As the Alabama Department of Insurance continues implementation of Act 2025-136, the Department has begun publishing PBM regulatory actions on our website. This step is intended to promote transparency and provide all stakeholders with greater visibility into the Department’s efforts to enforce the requirements established by the Legislature.

It is important to note that most of these posts are regulatory actions, not lawsuits. These are public documents and, therefore, should be made publicly available. By making these actions publicly available, the Department intends to keep stakeholders informed while continuing to carry out its statutory oversight responsibilities. Beyond posting these actions on the Department’s website, it will be the policy of the Department to rarely comment and will generally allow the documents speak for themselves.

The Department remains committed to implementing the statute as enacted and continuing to work with all stakeholders to ensure compliance with Alabama law. At the same time, we have had many productive discussions with several PBMs and appreciate their good-faith engagement and feedback as they work with the Department to come into compliance with the statute.
