What is the purpose of a predetermination?

The predetermination program was created for individuals with criminal records who are interested in obtaining a license in Alabama.  Potential applicants with criminal records may submit a predetermination request form  to receive guidance on how their circumstances may affect their formal application for licensure.

Who is the predetermination process for?

This process is intended for individuals who have not yet submitted a formal application for licensure and want to have their criminal history reviewed before applying for licensure. If you have already submitted a licensing application, please do not submit a request for a predetermination.

Am I required to complete a predetermination form?

No, you are not required to submit a predetermination. Requesting a predetermination is optional. You are not required to obtain one before submitting a formal license application. A formal licensing application is still required for licensure.

Does submitting a predetermination eliminate the need for a formal licensing application?

No. Applicants must still submit a formal licensing application.

If I submitted a formal licensing application, may I still apply for a predetermination?

No, the process is intended for applicants that have not yet submitted a formal application.

What information do I need to submit with the predetermination?

You must provide your complete criminal history and provide the criminal records that correspond with the offense(s) in addition to a completed application, statement explaining the convictions and $25.00 processing fee. Please have the information available to upload before assessing the  online application.

What type of offenses should I include?

Please include misdemeanor, felony, and military offenses, including any judgments withheld or deferred and current or pending charges.

What type of offenses may I exclude?

You may exclude traffic citations, misdemeanor traffic offenses (such as misdemeanor DUI or DWI, driving without a license or proof of insurance or with a suspended or revoked license, or reckless driving) and juvenile offenses (offenses where you were adjudicated in a juvenile court).

What happens after I submit the predetermination?

Your submission will be sent to the Alabama Department of Insurance and will be reviewed to determine if you have submitted all information needed to process. You will be contacted if additional information is needed. A determination will be made after all documentation is received. You will receive an email response with the probability of licensure.

Does submitting a predetermination guarantee my ability to successfully apply for licensure?

No. You will still need to complete all pre-licensing and licensing requirements for formal licensure. Refer to our website at www.aldoi.gov.

What is § 1033 consent?

Under 18 U.S.C. § 1033, it is a federal criminal offense for an individual who has been convicted of an offense described in that statute or of a felony involving dishonesty or breach of trust to engage in the business of insurance without the written consent of an insurance regulatory official authorized to regulate insurers.

If you have consent from another Department of Insurance, you must provide a copy of the § 1033 consent from the appropriate regulatory official of the resident licensing state or determination that a 1033 consent is not required (i.e., waiver). Please have the information available to upload before assessing the application.
